Notice of Availability of the Beta Streamflow Duration Assessment Methods for the Northeast and Southeast The U.S. Army Corps of Engineers (Corps) Baltimore, Buffalo, Charleston, Chicago, Detroit, Fort Worth, Galveston, Huntington, Jacksonville, Kansas City, Little Rock, Louisville, Memphis, Mobile, Nashville, New England, New Orleans, New York, Norfolk, Philadelphia, Pittsburgh, Savannah, St. Louis, Tulsa, Vicksburg, and Wilmington Districts, and the U.S. Environmental Protection Agency (EPA), Regions 1, 2, 3, 4, 5, 6, and 7 jointly announce the availability of the Beta Streamflow Duration Assessment Methods (SDAM) for the Northeast and Southeast (dated April 12, 2023). The methods are rapid assessment tools to help distinguish between ephemeral, intermittent, and perennial streamflow at the reach scale for the Northeast and Southeast SDAM Regions. The beta SDAMs may help provide technical guidance for identifying waters that may be subject to regulatory jurisdiction under Section 404 of the Clean Water Act; however, these methods do not alter or change the definition of “Waters of the U.S.” 04/12/2023

Proposed Regional General Permit for Minor Pier Activities

The U.S. Army Corps of Engineers, New York District, is soliciting comments on a proposal to issue a Regional General Permit for the installation and maintenance of open pile or floating: dock(s), deck, observation platform(s) in waters of the U.S., stairway(s), mooring pile(s), mooring buoy(s), swim platform, marine railway, boat hoist(s)/jet ski hoist(s), covered (not enclosed) boat slips and hoists, and boat whips. The authorized work is located in waters of the United States in the State of New York. The District will consider comments made during the 30 day public notice period. 02/14/2023
Proposed Regional General Permit for Boat Slip Fill The U.S. Army Corps of Engineers, New York District, is soliciting comments on a proposal to issue a Regional General Permit for the placement of fill in existing boat slips and boat wells that have been excavated into previously dry upland property. Final 41 Nationwide Permit Regional Condition for Announcement for State of New York  

On December 27, 2021, the U.S. Army Corps of Engineers (Corps) published a final rule in the Federal Register (86 FR 73522) announcing the reissuance of 40 existing nationwide permits (NWPs) and one new NWP. These 41 NWPs will go into effect on February 25, 2022, and will expire on March 14, 2026. The subject public notice includes the Nationwide Permit Regional Condition Announcement for the State of New York.

Wetland Mitigation Plan for the Mud Creek Preserve 

The New York District of the U.S. Army Corps of Engineers is soliciting comments and the identity of any potential interested parties while we consider the Wetland Trust proposal to construct a mitigation site in the Mid-Hudson service area of their existing Umbrella Mitigation Banking program. The proposed mitigation site is located at 109 Fish and Game Road in the Town of Claverack, Columbia County NY. This will enable the addition of a service areas in the Mid-Hudson Basin (02020006), in Hudson River Drainage in parts of the following Counties: Schenectady, Albany, Rensselaer, Schoharie, Greene, Columbia, Dutchess and Ulster, Counties, New York.

Ducks Unlimited-New York In-Lieu Fee Program Hudson River Service Area- Non-tidal Wetlands 

The New York District of the U.S. Army Corps of Engineers is soliciting comments and the identity of any potential interested parties while we consider Ducks Unlimited proposal to expand the service areas of their existing In Lieu Fee Mitigation instrument into the Hudson-Hoosic and Middle Hudson Watersheds.  The expansion areas would include portions of Saratoga, Warren, Washington and Rensselaer Counties (Hudson-Hoosic), and portions of Schenectady, Albany, Rensselaer, Schoharie, Greene, Columbia, Dutchess and Ulster Counties (Middle Hudson). There is not at present an application for work in waters of the United States for a DU sponsored mitigation area within these watersheds however authorization under section 404 of the Clean Water Act would be required for construction of the site. The Districts will consider comments made during the 30 day public notice period.

Nationwide Permit Regional Condition Announcement for State of New York On January 13, 2021, the U.S. Army Corps of Engineers (Corps) published the notice in the Federal Register (86 FR 2744) announcing the reissuance of 12 existing nationwide permits (NWPs) and four new NWPs, as well as the reissuance of NWP general conditions and definitions with some modifications. These 16 NWPs will go into effect on March 15, 2021, and will expire on March 14, 2026. 03/08/2021

The applicant, The Wetland Trust, has requested Department of the Army authorization to develop a mitigation site within the Mohawk Service Area (02020004) near the Erie Canal, Lock 19 located off NY Route 5 South, Town of Schuyler, Herkimer County, New York. The proposed activities on the Site would include re-establishing forested (PFO) wetlands; rehabilitating PFO wetlands; establishing upland buffer; preserving existing PFO wetlands; and preserving upland buffer. Preservation of the Site would be accomplished via the recordation of a conservation easement.

CENAN/EPA Region 2 Site Management and Monitoring Plan (SMMP) for the Historic Area Remediation Site (HARS)

Attached is the scheduled 10-year revision of the CENAN/EPA Region 2 Site Management and Monitoring Plan (SMMP) for the Historic Area Remediation Site (HARS).  This document summarizes the results of site management and monitoring activities conducted since the site’s 1997 designation and the progress made to date in remediating HARS Priority Remediation Areas by placing at least one meter of Category I dredged material over 95% of surface sediments.  This document also describes the site management and monitoring approaches that are proposed for use at HARS to manage and monitor materials placed at the site until the SMMP's next 10-year revision.  Stakeholder comments will be accepted until 30 calendar days after publication of this notice.   Point of Contact at CENAN is Ryan Corbett:  ryan.p.corbett@usace.army.mil.  Point of Contact at EPA Region 2 is Julia Perzley:  Perzley.Julia@epa.gov.

REGULATORY OPERATIONS IN RESPONSE TO COVID-19 AND REQUEST FOR ELECTRONIC APPLICATION SUBMITTAL

We are closely monitoring the effect of COVID-19 on our community. The Secretary of Defense has given local commanders the flexibility to respond to conditions in their areas to effectively carry out their respective missions and meet the critical needs of their people. As such, the New York District Commander has implemented numerous measures to keep our employees, their families and the public safe, while still maintaining our public service commitment. The Regulatory Branch offices at 26 Federal Plaza in New York City and the Upstate Regulatory Field Office in Watervliet, NY are closed to the public until further notice. However, our Regulatory staff is working diligently to process existing actions and new submittals electronically.

New York District Regional General Permit-25 (NYDGP-25) 

NYDGP-25 authorizes New York City Department of Environmental Protection to  discharge excavated or fill material into waters of the United States, including discharges associated with Best Management Practices (BMPs) for reducing storm water flooding, including outlet stilling basins, extended detention basins, which include micropools, forebays, and weirs, as well as, stream restoration and diversion, wetland enhancement and establishment, culvert repair and construction and outfall repair and construction within the Borough of Staten Island, Richmond County, New York.

Waters of the United States Step 1

Clean Water Act Final Rule Repealing the 2015 Clean Water Rule and Re-Codifying the previous definition of the "Waters of the U.S."

On September 12, 2019, the Environmental Protection Agency and Department of the Army (the agencies) signed a final rule to repeal the 2015 Clean Water Rule (2015 Rule) and re-codify the regulatory text defining "waters of the United States" (WOTUS) that existed prior to the 2015 Rule. This action will, when effective, provide regulatory certainty as to the definition of "waters of the United States" in light of ongoing litigation over the 2015 Rule. This final rule will be implemented in accordance with Supreme Court decisions, agency guidance, and longstanding practice.

NAN-2019-00051Issuance of New General Permit for Coastal Areas to Replace the Expiring NYDGP-15

The New York U.S. Army Corps of Engineers is soliciting comments on a proposal to issue a Regional General Permit (RGP), which would authorize emergency response and storm recovery activities in regulated waters in New York State in the following counties (NYSDEC Regions 1 and 2): Suffolk, Nassau, Queens, Kings, New York, Richmond, and Bronx. The proposed RGP would also be applicable for properties abutting the Hudson River up to River Mile 100 within the following counties (NYSDEC Region 3): Westchester, Rockland, Ulster, Orange, Putnam, and Dutchess. This RGP would replace the NYDGP-15 expiring on April 18, 2019.

Clean Water Act Proposed Rule for a Revised Definition of the "Waters of the U.S."

The U.S. Environmental Protection Agency (EPA) and the Department of the Army announced today the publishing in the Federal Register of the proposed new definition of "waters of the United States" that clarifies federal authority under the Clean Water Act.  The notice is available at https://www.federalregister.gov/documents/2019/02/14/2019-00791/revised-definition-of-waters-of-the-united-states. The agencies' proposal is the second step in a two-step process to review and revise the definition of "waters of the United States" consistent with the February 2017 Presidential Executive Order entitled "Restoring the Rule of Law, Federalism, and Economic Growth by Reviewing the 'Waters of the United States' Rule." The publishing of the proposal and outreach efforts were delayed due to the lapse in appropriations for EPA. Today's notice begins a 60-day public comment period that will close on April 15, 2019. EPA and the Army will hold an informational webcast on February 14, 2019, and will host a listening session on the proposed rule in Kansas City, KS, on February 27-28, 2019. the U.S. Army Corps of Engineers (USACE) plans to prepare a General Reevaluation Study (GRR) with an integrated Environmental Impact Statement (EIS) to evaluate environmental impacts from reasonable project alternatives and to determine the potential for significant impacts related to the improvement of the anchorages included in the Federal navigation project to take into account changed conditions and/or assumptions since the original feasibility study was completed in 2000. The GRR will address the need for anchorage areas capable of safely accommodating the vessels navigating the anchorages at present and reasonably projected to be navigating them in the future; or find that no plan is currently justified.

Guidance for Performing Tests on Dredged Material Proposed for Ocean Disposal

The New York District US Army Corps of Engineers (NYD) and the US Environmental Protection Agency, Region 2 (EPA) have revised the Regional Testing Manual (RTM), entitled “Guidance for Performing Tests on Dredged Material Proposed for Ocean Disposal,” that is used to evaluate the suitability of dredged material for use as Remediation Material at the HARS. This document sets forth the testing guidelines and requirements to be referenced by applicants in obtaining Department of the Army (DA) authorization from the New York District (NYD) for transportation and placement of dredged material from the Port of New York and New Jersey at the Historic Area Remediation Site (HARS) in the Atlantic Ocean pursuant to Section 103 of the Marine Protection, Research, and Sanctuaries Act. The manual lists administrative requirements for completing ocean placement permit applications, as well as specific requirements and protocols for sampling and testing of proposed dredged material. This manual updates and supersedes the existing regional implementation manual entitled “Guidance for Performing Tests on Dredged Material to be Disposed of in Ocean Waters” (USACE NYD/EPA Region 2, 1992). 4/20/2016

The 123.8 acre site is known as the former Riverbed Golf Course site located in the Town of New Berlin, Chenango County, New York. A draft mitigation plan has been received for this site pursuant to 33 CFR 332 and 40 CFR 230. There is not at present an application for work in waters of the United States at this site however authorization under section 404 of the Clean Water Act would be required for construction of the site. Withdrawal of Clean Water Act Interpretive Rule for 404(f)(1)(A) On January 29, 2015, the U.S. Environmental Protection Agency (EPA) and the U.S. Department of the Army (Army) signed a memorandum withdrawing an interpretive rule that addressed an exemption from permitting provided under section 404(f)(1)(A) of the Clean Water Act (CWA). On March 25, 2014, both agencies signed an interpretive rule, “Interpretive Rule Regarding Applicability of the Exemption from Permitting under Section 404(f)(1)(A) of the Clean Water Act to Certain Agricultural Conservation Practices,” that addressed applicability of the permitting exemption provided under section 404(f)(1)(A) of the CWA to discharges of dredged or fill material associated with certain agricultural conservation practices. Congress subsequently directed the agencies to withdraw this interpretive rule. The Memorandum of Understanding signed on March 25, 2014, by EPA, Army, and the U.S. Department of Agriculture concerning the interpretive rule is also withdrawn. These actions are effective immediately. 2/2/15

The New York District and Buffalo District of the Army Corps of Engineers are requesting comments on a proposed modification of the existing In-lieu fee program sponsored by The Wetland Trust, to provide mitigation for impacts to waters of the United States. Currently the In-lieu fee program is within five separate 8-digit Hydrologic Unit Code (HUC) service areas within the State of New York. Expanded service areas within the New York District would be available in all or parts of the following counties: Hamilton, Fulton, Montgomery Otsego, Schoharie, Schenectady, Saratoga, Delaware, Greene, Albany and Sullivan Counties.

Clean Water Act Proposed WOUS Rule - Additional Comment Period Extension On 21 April 2014, the USEPA and the Corps of Engineers (Corps) published for public comment a proposed rule defining the scope of waters protected under the Clean Water Act (CWA), in light of the U.S. Supreme Court cases in U.S. v. Riverside Bayview, Solid Waste Agency of Northern Cook County v. U.S. Army Corps of Engineers (SWANCC), and Rapanos v. United States (Rapanos). The proposed rule was developed to enhance protection for the nation’s public health and aquatic resources, and increase CWA program predictability and consistency by increasing clarity as to the scope of “waters of the United States” protected under the Act. The comment period which was originally scheduled to end on July 21, 2014, had been previously extended to October 20, 2014.  Comments now must be received on or before November 14, 2014.  6/11/2014 
 Re-Issuance of NYDGP-15 The New York District announces the re-issuance of NYDGP-15, which authorizes activities in waters of the United States to facilitate the remediation of sites that are damaged from major storms that result in a Federal and/or State disaster declaration.  It applies to waters of the United States that lie within the jurisdiction of the New York District in the specific towns or counties in New York State that are identified in the disaster declaration. 7/2/2014

 Clean Water Act Interpretive Rule for 404(f)(1)(A) Reopening of Comment Period for the Interpretive Rule On 21 April 2014, the USEPA and the Corps of Engineers (Corps) published a Notice of Availability and Public Comment (79 FR 22276) to announce the availability of an interpretive rule regarding the applicability of the exemption from permitting provided under section 404(f)(1)(A) of the Clean Water Act (CWA) for discharges of dredged and/or fill material associated with certain agricultural conservation practices based on the Natural Resources Conservation Service (NRCS) conservation practice standards that are designed and implemented to protect and enhance water quality.  The interpretive rule was effective on April 03, 2014.  The public comment period has been reopened through July 07, 2014, in response to stakeholder requests.  Comments submitted between the close of the original comment period and the re-opening of this comment period will be accepted and considered.   6/11/2014

Riverside Bayview, Solid Waste Agency of Northern Cook County v. U.S. Army Corps of Engineers (SWANCC), and Rapanos v. United States (Rapanos). The proposed rule was developed to enhance protection for the nation's public health and aquatic resources, and increase CWA program predictability and consistency by increasing clarity as to the scope of "waters of the United States" protected under the Act.   4/18/2014 
Clean Water Act Interpretive Rule USACE and USEPA are publishing a Notice of Availability and Public Comment to announce the availability of an interpretive rule regarding the applicability of the exemption from permitting provided under section 404(f)(1 )(A) of the Clean Water Act (CWA) for discharges of dredged and/or fill material associated with certain agricultural conservation practices based on the Natural Resources Conservation Service (NRCS) conservation practice standards that are designed and implemented to protect and enhance water quality.  Proposed Re-Issuance of NYDGP-15 The New York District is soliciting comments on their proposal to re-issue a regional general permit that authorizes the installation of structures and dredging in navigable waters and the discharge of dredged or fill material, including discharges associated with excavation activities, into waters of the United States to facilitate the remediation of sites that are damaged from major storms that result in a Federal and/or State disaster declaration. 2/13/2014 
 Public Information Announcement NAN-2013-00849  Over the past few weeks of June - early July 2013, persistent severe rain storms, subsequent flooding and other storm related damages in New York State have resulted in State disaster declarations for eight (8) counties within the regulatory boundaries of the New York District of the United States Army Corps of Engineers. Locations outside of these counties could also receive State and/or Federal disaster declarations while the threat of the severe storms persists. It is anticipated that owners of damaged property will want to conduct repair activities in the near future. On November 16, 2011, the U.S. Army Corps of Engineers published in the Federal Register its request for comments regarding our proposal under Executive Order 13563, "Improving Regulation and Regulatory Review," issued on January 18, 2011.  The Regulatory Program of the U.S. Army Corps of Engineers (USACE) is seeking public input on its plan to retrospectively review its Regulations implementing the USACE Regulatory Program at 33 CFR 320-332 and 334.

The US Army Corps of Engineers New York District, proposes to issue an order assessing a Class I Administrative Penalty against Thomas Building and Development Company.  A Department of the Army authorization was issued to the Permittee on June 29, 2006.  A special condition of the authorization required that the Permittee secure a deed restriction on 6.36 acres of land, to guarantee preservation of the land for wetland and wildlife purposes.  This deed restriction was to be filed on or before August 27, 2006.  The Permittee filed a deed restriction meeting the requirements of the authorization on June 13, 2007, more than nine months after such filing was due.

The US Army Corps of Engineers New York District, proposes to issue an order assessing a Class I Administrative Penalty against North Manor Development, LLC.  A Department of the Army authorization was issued to the Permittee on July 20, 2006.  A special condition of the authorization required that the Permittee secure a deed restriction on 35.91 acres of land.  This deed restriction was to be filed on or before September 18, 2006.  The Permittee filed a deed restriction meeting the requirements of the authorization on April 15, 2010, after commencement of work on the project site and more than three years, six months after such filing was due.
