Navigable Waters List for New York State

The following is a list of navigable waters in New York State that are regulated under Section 10 of the Rivers and Harbors Act within the New York District’s area of responsibility.  Please utilize this list to help you identify which waters within the listed New York county are considered to be navigable waters of the U.S., regulated under Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. 403).   Please note that the absence of a water from this list should not be taken as an indication that it is not navigable.  The New York District makes no claim that this list is complete. For instance, any water that is subject to the ebb and flow of the tide would also be considered navigable under Section 10.

This list is for regulatory reference purposes only. It is not a substitute for a jurisdictional determination.  Please also note that each Section 10 waterway might not be considered navigable for its entire length.  Please contact the New York District at CENAN-R-Permit-App@usace.army.mil if there is any question as to the extent of Section 10 authority for a waterway in your project area.
