New York District Regional General Permits within the State of New York

A Regional General Permit (RGP) is a type of general permit that authorizes categories of activities in a specific geographic area that causes only minimal individual and cumulative environmental impacts:

New York State Programmatic General Permit Applications 

A State Programmatic General Permit (SPGP) is a type of general permit founded on an existing state, local or other Federal agency program and designed to avoid duplication with that program. The following SPGPs are applicable within the State of New York:

  • NYSPGP-1 - This SPGP authorizes activities to facilitate the recovery and restoration of damaged properties, projects, aquatic resources, and infrastructure following major storm events. This SPGP authorizes these activities throughout all of New York State except Tribal/Native Nation lands and within NYSDEC Region 1 (Long Island), NYSDEC Region 2 (New York City), and within NYSDEC Region 3 all Coastal Erosion Hazard Areas regulated by Article 34 of the Environmental Conservation Law and all tidal wetlands regulated by Article 25 of the Environmental Conservation Law including those located along the Hudson River south of the Tappan Zee Bridge. This SPGP is valid from 21 December 2023 to 21 December 2028.

Joint New Jersey State Programmatic General Permit Applications

A State Programmatic General Permit (SPGP) is a type of general permit founded on an existing state, local or other Federal agency program and designed to avoid duplication with that program. The following SPGPs are applicable within the State of New Jersey:

  • NJSPGP-17 - This SPGP authorizes the construction of structures; performance of work and the discharge of dredged and fill material in substantially developed artificial tidal lagoons and their access channel. Lagoons are defined as artificially created linear waterways sometimes branched, ending in a dead end with no significant upland drainage. A natural waterway, which is altered by activities including, but not limited to, filling, channelizing, or bulkheading shall not be considered a lagoon. A bulkheaded boat slip shall not be considered a lagoon. This SPGP is applicable to Waters of the United States in the State of New Jersey located in substantially developed artificial tidal lagoons and their access channel within the geographic boundaries of both the Philadelphia District and the New York District, U.S. Army Corps of Engineers. This SPGP is valid from 29 December 2022 to 31 December 2022. 
     
  • Notification of Work Commencement Form 
     
  • NJSPGP-19 – This SPGP authorizes the construction of proposed and maintenance of existing non-commercial piers, docks, gangway/ramps, stairs/ladders, mooring piles, boat lifts, breakwaters, the replacement of existing serviceable bulkheads and minor maintenance dredging of mooring slips. This SPGP also authorizes the discharge of fill material between existing and proposed bulkheads as well as legalization of previously existing structures provided the structures meet all terms and conditions of this permit. This SPGP is applicable to navigable waters of the United States in the State of New Jersey and to navigable waters located within the geographic boundaries of both the Philadelphia District and the New York District, U.S. Army Corps of Engineers. This SPGP is valid from 31 December 2019 to 21 December 2024.

Archived Regional and State Programmatic General Permit Applications

Regional General Permits (RGPs):

  • NYDGP-20 - (Expired: 11 Feb 2016) This RGP authorizes work in navigable waters of the U.S. and discharges of fill materials into waters of the U.S. to facilitate military construction projects at the Fort Drum Military Reservation.
  • 11GP2 - (Expired: 12 Aug 2010) This RGP authorizes the construction of rock-filled timber crib piers in waterways located in eight upstate New York counties. This RGP is applicable in Clinton, Essex, Franklin, Fulton, Hamilton, Saratoga, Warren and Washington counties.
  • NYDGP-15 - (Expired: 18 Apr 2019) This RGP authorizes the installation of structures and dredging in navigable waters and the discharge of dredged or fill material, including discharges associated with excavation activities, into waters of the United States to facilitate the remediation of sites that are damaged from major storms that result in a Federal and/or State disaster declaration.

Joint New Jersey State Programmatic General Permits (SPGPs):

  • SPGP-17 - (Expired: 31 Dec 2012) This SPGP authorizes the construction of structures; performance of work and the discharge of dredged and fill material in substantially developed artificial tidal lagoons and their access channels.
  • SPGP-19 - (Expired: 31 Dec 2009) This SPGP is for existing and proposed non-commercial piers, docks, mooring piles, boat lifts, timber breakwaters, and the replacement of existing bulkheads within eighteen (18) inches of existing serviceable bulkhead structures.
