The mission of the U.S. Army Corps of Engineers, New York District's Regulatory office is to protect the Nation’s aquatic resources and navigation capacity, while allowing reasonable development through fair, flexible and balanced decisions.

 

The New York District Regulatory Division has jurisdiction over waters of the U.S. that are distributed across the states of New York and New Jersey. 

 

The USACE Regulatory Program administers Section 404 of the Clean Water Act (CWA), Section 10 of the Rivers and Harbors Act of 1899, and Section 103 of the Marine Protection, Research and Sanctuaries Act (MPRSA), regulating activities that may impact wetlands and waters of the United States.

In 2025, the U.S. Army Corps of Engineers introduced its new Regulatory Request System (RRS), an online application portal that allows the public to submit permit applications and other information when requesting permission to dredge, fill or conduct activities in jurisdictional wetlands and waters of the U.S.

 

RRS is accessible at https://rrs.usace.army.mil/rrs.

 

RRS users can submit individual permit applications, general permit pre-construction notifications, jurisdictional determination requests, and other information needed during the permit evaluation process using easy-to-follow online submission forms. Applicants can also track the status of their requests using a user-friendly dashboard. 

 

RRS benefits the applicant by eliminating the burden associated with the preparation and mailing of paper applications. It also reduces some of the effort associated with processing applications and data entry making the permitting process more efficient. This rapid approach is based on the Hydrogeomorphic (HGM) approach to assess palustrine wetlands within the State of New York. This method utilizes established approaches to:

 

(1) characterize regional wetlands

(2) provide the rationale used to determine assessment scores

(3) describe assessment variables utilized

(4) outline the assessment equations

(5) provide a step-by-step protocol for collecting the data to be used in the assessment. 

 

The State of New York is comprised of a wide variety of landforms that exhibit mountains, rolling hills, plateaus, valleys, along with numerous lakes, streams, rivers and coastal areas associated with the Great Lakes.  As a result, the assessment developed utilizes an approach the incorporates both on-site data collection and off-site review of desktop resources.
