It is not a substitute for a jurisdictional determination.  Please also note that each Section 10 waterway might not be considered navigable for its entire length.  Please contact the New York District at CENAN-R-Permit-App@usace.army.mil if there is any question as to the extent of Section 10 authority for a waterway in your project area.

Please note that the absence of a water from this list should not be taken as an indication that it is not navigable.  For instance, any water that is subject to the ebb and flow of the tide would also be considered navigable under Section 10.
